中国残疾青少年体育纠纷解决机制的问题审视和路径优化——基于对美国、英国和澳大利亚案例的考察

摘　　要：残疾青少年体育纠纷除具有体育纠纷的特殊性以外,还具有公益性、扶助性等自身特点。运用案例分析和比较研究的方法,在梳理中国残疾青少年体育权利和纠纷解决机制历史的基础上,考察美国、英国和澳大利亚残疾青少年体育纠纷的经典案例,对其解决机制与特点进行分析。在新修订《体育法》的实施背景下,提出残疾青少年体育纠纷解决机制的优化路径:构建校内调解机构、鼓励第三方调解机构解决残疾青少年体育纠纷;构建内外结合的体育仲裁体系,设置快速体育仲裁程序;完善残疾青少年体育诉讼机制,注重诉调对接,引入临时禁令制度。In addition to the characteristics of sports disputes,sports disputes of youth with disabilities also have their own character-istics such as public welfare and supportive nature.Using the methods of case analysis and comparative study and based on the histo-ry of sports rights and dispute resolution mechanisms for disabled youth in China,the paper examines the classic cases of sports dis-putes of disabled youth in the United States,the United Kingdom and Australia,and analyzes their resolution mechanisms and char-acteristics.In the context of the implementation of the newly revised Sports Law,the optimization path of the sports dispute resolu-tion mechanism for youth with disabilities is proposed as constructing school-based mediation institutions and encouraging third-party mediation institutions to resolve sports disputes of youth with disabilities;constructing a sports arbitration system combining internal and external aspects,and setting up a fast-track sports arbitration procedure;and perfecting the litigation mechanism of sports for youth with disabilities and focusing on the docking of litigation and mediation and the introduction of a temporary injunction system.
