规则正畸:知识产权行为保全中的利益平衡路径

摘　　要：在以知识产权为核心的大国博弈中,合理利用行为保全是保护知识产权的重要举措,但却因当事人间的程序利益失衡而出现功能异化。《知识产权行为保全规定》的发布,没有从制度层面扭转被申请人处于弱势地位的局面,具体表现为被申请人的程序参与及程序救济的匮乏。保全程序克减被申请人的程序权益的正当性基础在于其包含的实体法与诉讼法的双重属性,但知识产权行为保全特殊性缺乏倾斜保护一方当事人的必要性。在明确行为保全略式诉讼程序性质的基础上,应限制法院依职权启动保全、细化审前询问规则、扩宽反担保适用范围并明确反向行为保全等规则,以打破当前困境,充分释放知识产权行为保全制度能效。In the world of intellectual property rights,the rational use of act preservation is a vital step in the protection of intellectual property rights.However,owing to the imbalance of procedural interests between the parties,it is functionally alienated.The introduction of the Provisions on the Preservation of Intellectual Property Rights has not reversed the situation of the respondent's disadvantaged position from the institutional level.This is specifically manifested in the lack of procedural participation and relief for the respondent.The procedure derogates the procedural rights and interests of the respondent's legitimacy,based on its inclusion of substantive law and procedure law of the dual attributes.Nevertheless,the specificity of intellectual property behavioral preservation lacks the necessity to protect a party in a favorable manner.To break the current dilemma and release the energy efficiency of the act preservation to the fullest extent,the court should be restricted from initiating preservation ex officio.Pre-trial inquiries should be refined while expanding the scope of application of counter-guarantee,and the rules of reverse behavioral preservation should be clarified.
