摘　　要：区域协同立法对解决地方立法间的冲突、构建一体化的区域法治环境、促进区域内的深度合作具有重要意义。虽然我国立法规定了区域协同立法制度,但在实施中仍存在法律规范供给不足的问题,包括协同主体存在争议、协同权限不明确、协同形式未确定、协同立法效力未明确,以及协同的底线未划定等。应基于区域合作及协同立法的现实要求,加强区域协同立法制度实施的法律规范供给,尤其要根据区域协同立法内容“一致性”或“互补性”及协同立法形式的“紧密型”特点,明确具有立法权的地方政府的协同立法主体地位和立法权限,鼓励创新协同立法形式,赋予协同立法文本更高的法律效力。此外,还要划定协同立法不能形成新的区域保护主义的底线。Regional cooperative legislation is of great significance in resolving conflicts between local legislations, building an integrated regional legal environment, and promoting in depth regional cooperation. Although the system of regional cooperative legislation has been confirmed in law, there are still problems of insufficient supply of legal norms in its implementation. These problems include that the subject of coordination is controversial, the authority of coordination is not clear, the form of coordination is not determined, the effect of legislation is not stipulated and the bottom line of coordination is not defined. Based on the practical requirements of regional cooperation and cooperative legislation, the supply of laws for the implementation of regional cooperative legislation should be strengthened, in particular,according to the “consistency” or “complementarity” of the contents of regional cooperative legislation and the “compact” form. It is necessary to define the subject status and legislative authority of the local government with legislative power, and to encourage the innovation of the form of cooperative legislation and give it higher legal effect. In addition, the bottom line is that regional cooperative legislation can not create new regional protectionism.
