元宇宙图书馆数字化建设的著作权困境和纾解

摘　　要：元宇宙与图书馆的结合产生元宇宙图书馆。元宇宙图书馆在馆藏资源数字化、远程数字借阅两方面面临著作权困境,这不利于元宇宙图书馆的数字化建设。为纾解该困境,提出了元宇宙图书馆数字化建设的著作权规制方案。针对馆藏资源数字化问题,提出构建“选择+退出”默示许可机制;针对远程数字借阅问题,主张将虚拟场馆纳入“馆舍”概念并选择受控数字借阅来出借数字版本作品,以推动元宇宙图书馆数字化建设的开展。The combination of the meta-universe and the library produces the meta-universe library.And the metauniverse library is faced with copyright dilemma in two aspects of collection resources’digitization and remote digital lend⁃ing,which is not conducive to the digitization construction of meta-universe library.In order to alleviate this dilemma,this paper puts forward a copyright regulation scheme for the digital construction of meta-universe library.Aiming at the digitization of collection resources,this paper puts forward the construction of“opt-out”implied license mechanism,and in view of remote digital lending,suggests that virtual venues should be included in the concept of“library”and con⁃trolled digital lending should be selected to lend digital versions of works,so as to promote the implementation of digital construction of meta-universe library.
