摘　　要：人口老龄化快速发展是我国当前的社会现实,养老保障问题成为社会关注热点。应对人口老龄化背景下养老保障问题的法律需要遵循系统观念,在体系上应当实现“纵横一体化”;在内容上应当围绕“一老一小”制定具体法律抓手,重点突出老年人的生活保障与权利保护,并统筹兼顾生育、就业等方面。要维护老年人的社会参与权和劳动权,有效应对人口老龄化带来的养老压力;又要优化生育政策减轻生育负担,促进人口结构改善与人口长期均衡发展,从根本上解决养老保障问题。完善应对人口老龄化背景下养老保障问题的法律体系,将更好地推进中国式现代化进程。The rapid development of population aging is a current social reality in China,and the issue of elderly care security has become a hot topic of social concern.The legal frame-work for addressing the issue of elderly care security in the context of aging population needs to follow a systematic approach,and the system should achieve"vertical and horizontal integra-tion";In terms of content,specific legal measures should be formulated around"old and young",with a focus on highlighting the living security and rights protection of the elderly,and taking into account aspects such as childbirth and employment.It is necessary to establish a sound legal system for elderly care security,safeguard the social participation and labor rights of the elderly,and effectively alleviate the pressure of aging population on elderly care.It is need to optimize the birth policy to reduce the burden of childbirth,promote population struc-ture improvement and long-term balanced development,and fundamentally solve the problem of elderly care security.Improving the legal system to deal with pension security issues in the context of population aging will better promote the process of Chinese path to modernization.
