摘　　要：本文结合国内外学者的研究现状,对默示意思表示概念进行梳理整合,进而揭示其本质特征,即“表意间接性”。对默示意思表示解释的现实意义予以阐述,以“信赖利益”原则为指导,对具体的解释规则予以阐述。对司法适用中出现的界定不准确和同案不同判等问题进行研究,指出默示意思表示的实践适用困境,提出侧重高质量立法供给及强化司法适用功能的建议。First of all,based on the analysis of the basic concepts,and combined with the research status of scholars at home and abroad,this paper tries to sort out and integrate the concept of implied manifestation of intent and reveal its essential characteristics,that is,the"ideographic indirectness".Secondly,it expounds the practical significance of the interpretation of implied meaning,refers to the value orientation of the whole civil law,and extracts the principle of"reliance interest"from the value orientation as the guidance,so as to elaborate the specific interpretation rules.Finally,it studies the problems of inaccurate definition and different judgments in the same case in judicial application,points out the practical application dilemma of implied manifestation of intent,and puts forward suggestions that focus on high-quality legislative supply and strengthen the function of judicial application.
