长三角饮用水水源保护生态补偿法律形塑——以太浦河为例

摘  要:太浦河作为长三角地区重要的跨界河流,对长三角生态绿色一体化发展意义重大。生态补偿法律调控,可有效保障太浦河流域环境正义的合理配置、稀缺利益的公平分配以及激励功能的有效实现。长三角地区生态补偿法律制度散见于宪法、环境保护相关法律、行政法规以及地方性法规中,生态补偿标准、补偿方式、法律责任承担等方面仍存在明显不足。长三角地区的生态补偿实践主要有水质交易、异地开发和水权交易等,但也面临诸多法律困境。因此,以太浦河为例,长三角地区流域生态补偿的法律调控,应从明确生态补偿的权利义务主体、生态补偿法律标准、生态补偿法定方式、生态补偿管理机构、生态补偿产权法定以及纠纷解决机制等方面着手。As an important transboundary river in the Yangtze River Delta,the Taipu River is of great significance to the development of the ecological green integration of the Yangtze River Delta.The legal regulation of ecological compensation can effectively guarantee the reasonable allocation of environmental justice in the Taipu River Basin,the fair distribution of scarce benefits,and the effective realization of incentive functions.The legal system of ecological compensation in the Yangtze River Delta is scattered in the Constitution,environmental protection laws,administrative regulations and local regulations.There are still obvious deficiencies in ecological compensation standards,compensation methods,and legal responsibility.The practice of ecological compensation in the Yangtze River Delta mainly includes water quality trading,off⁃site development and water rights trading,but it also faces many legal dilemmas.Therefore,taking the Taipu River as an example,the legal regulation of ecological compensation in the Yangtze River Delta should clarify the rights and obligations of ecological compensation,legal standards for ecological compensa⁃tion,legal methods for ecological compensation,ecological compensation management institutions,ecological compensation property rights,and dispute resolution mechanisms.
