行政知识嵌入行政法学的路径选择——以2005~2021年CLSCI文献引用数据引入

摘　　要：面对行政法学日益孤立封闭的发展困境,行政法学界主动尝试引入行政知识来改良行政法学知识体系。然而,行政学的基础性功能究竟体现在哪些方面,却一直未能得到厘清和证实。鉴于文献引用具有作为考察学科间关系的重要指标价值,本文以CLSCI中的15种期刊为样本,统计2005~2021年行政法学文章中的行政学文献引用情况,发现并证实行政学对于行政法学的三重功能:背景上的描述解释功能、概念上的前置整合功能以及研究视角上的平衡功能。在澄清法教义学与学科属性差异非嵌入困境之主因的基础上,反思行政过程论和政府规制论的局限性。相较而言,政策导向之行政法学由于具有整体嵌套性的优势,能够调和与法教义学的矛盾,实现行政知识的体系化嵌入,因此成为行政知识嵌入行政法学的最佳路径。Faced with the increasingly isolated and closed development dilemma of administrative law,administrative law scholars take the initiative to introduce administrative knowledge to improve the knowledge system of administrative law.However,the basic function of administration has not been clarified and confirmed.In view of the value of bibliography as an important indicator to examine the relationship between disciplines,taking 15 CLSCI journals as samples,this paper makes statistics on the bibliography of administrative science in administrative law articles from 2005 to 2021,and finds and confirms the triple functions of administrative science for administrative law:The function of description and interpretation in the background,pre⁃integration in the concept and balance in the perspective of research.On the basis of clarifying the main cause of the non⁃embedding dilemma caused by legal doctrinalism and the difference of disciplinary attributes,the author reflects on the limitations of administrative process theory and government regulation theory.In contrast,policy⁃oriented administrative law is the best way for administrative knowledge to be embedded in administrative law because it has the advantage of overall nesting,can reconcile the contradiction with law doctrine,and realize the systematic embedding of administrative knowledge.
