摘　　要：实践中将动态IP“秒拨”服务提供行为认定为“提供侵入、非法控制计算机信息系统程序、工具罪”“非法经营罪”“帮助信息网络犯罪活动罪”等的处理模式存在严重缺陷,不可取;共犯处理模式具有一定的合理性,但也存在明显的局限性。动态IP“秒拨”服务提供行为,其本质上是对被提供者信息网络违法犯罪预备行为的帮助,其通过信息网络发布服务信息可以评价为“为他人实施信息网络违法犯罪预备活动”而发布技术支持信息的行为,符合非法利用信息网络罪的行为类型,也契合非法利用信息网络罪的“微罪”属性和“预备行为正犯化”特征,原则上成立非法利用信息网络罪。当例外同时符合以上其他罪名的构成要件时,根据想象竞合的处断原则,成立相应的罪名。In practice,the dynamic IP“second dialing”service provision behavior is identified as“the crime of providing intrusion,illegally controlling computer information system programs and tools”,“the crime of illegal operation”and“the crime of helping information network criminal activities”,which have serious defects and are not desirable.The mode of accomplice has certain rationality,but also has obvious limitations.The dynamic IP“second dialing”service provision behavior is essentially to help the provided information network crime preparation behavior.Its service information release through the information network can be evaluated as the behavior of releasing technical support information for“implementing information network crime preparation activities for others”,which is in line with the behavior type of illegal use of information network crime,and also conforms to the“petty misdemeanor”attribute of the crime of illegal use of information network and the characteristics of“perpetration of preparatory acts”,and establishes the crime of illegal use of information network in principle.When it meets the constitutive requirements of the above other charges exceptionally,establish the corresponding crime according to the principle of imaginative concurrence.
