稳定的劳动关系与中国的可持续发展——读《中华人民共和国劳动合同法<草案>》有感

摘　　要：劳动合同法草案在劳动法基本原则的基础上,总结了近15年来中国在劳动制度改革方面的经验和教训,直面劳动法律关系中较多发生的冲突,权威地甚至是强硬地制定了一些规则,表明了国家对劳动法律关系的高度干预。中国的劳动合同立法是应当提供一部低标准、广覆盖的法律,还是在现行的经济发展基础上制定一部侧重鼓励和支持建立稳定劳动合同关系的法律?这也是劳动合同法草案颁布后争论最激烈的问题。纵观劳动合同法草案的全文,不难看出,鼓励建立稳定和谐的劳动关系是劳动合同法草案的核心,也是解决因劳动合同短期化而引发的劳资关系激烈冲突的重要措施,是劳动合同立法的主要出发点。稳定的劳动合同关系究竞对中国持续发展的竞争力会产生什么样的影响?本文以此为核心对劳动合同法草案的颁布进行了一些分析和探讨。The draft of the labor contract law has summed up the experience and lesson of the labor system reform of China in the recent 15 years on the basis of the fundamental rule of labor law.It straightly confronts the authority and the conflicts which usually happen in the labor law relation;it even regulated in a strong language which shows how the country highly interferes the labor law relation.Should the labor contract law be a law of low standard and broad coverage?Or should it be a law which formed on the basis of economic development and major in encouraging and supporting of establishment of the stable labor law relation?This is the most attention-getting argument after the issuance of the draft of the labor contract law.Looking through the full text of the draft of the labor contract law,we will not feel hard to fine that to set up the stable labor law relation is the core of the draft of the labor contract law,the important key to the settlement of the short-time labor contract conflict between the employer and employee and the jumping-off place of labor legislations.What influence will a stable labor contract relation bring to China's sustainable development?This thesis will take this as a core,analyze and discuss the draft of the labor contract law.Key Word:The draft of the labor contract law,stable physical labor relation,China's sustainable development.
