摘　　要：新民诉法对二审案件的处理方式进行了完善。新法明确了裁定上诉后的具体处理方式;完善了发回重审制度,修改了发挥重审的事实标准、程序标准以及次数限制;细化了二审程序中判决、裁定依法撤销、变更的处理方式。新民诉法对二审程序的完善,有助于司法资源的优化配置以及当事人的合法权益的保护。The new Civil Procedure Law has improved the case decision mechanism in the second instance.The new law provides the specific ways for handling with the decisions appealed;improves the remand for retrial system whereby modifying the factual and procedural standards and the number limitation of times of remand for retrial;refines the ways for the appellate proceeding to reverse or change the judgment or decision of the first instance.These improvements of the appellate procedure by the new Civil Procedure Law contributes to the optimal allocation of judicial resources and the protection of parties'legal rights and interests.
