摘　　要：未成年人保护处分制度是以预防未成年人实施犯罪为目的,针对实施了严重不良行为的未成年人所采取的一系列处遇手段。当下保护处分制度内容的模糊不明、实施主体的力量薄弱、具体实施程序的规范缺失、专门学校建设进程缓慢等问题,是影响当前我国保护处分制度实践效果的重要因素。为此,应当明确未成年人保护处分制度的功能定位,并对具体措施的决定程序进行司法化改造。同时,为给保护处分制度的有效落实提供现实抓手,有必要从组建专门的未成年人警务部门、将调查评估工作以政府购买社会服务的方式“外包”,推进专门学校的建设三方面具体展开.The juvenile protection punishment system is a series of treatment measures for minors who have committed serious bad acts in order to prevent minors from committing crimes.At present,the content of this system is unclear,the implementation of the main force is weak,the procedures are not standardized,and the construction of specialized schools is slow,which affects the practical effect.Therefore,the functional orientation of the juvenile protection punishment system should be clarified,and the procedures for determining specific measures should be judicialized.At the same time,in order to effectively implement this system,it is necessary to set up specialized juvenile police units and“outsourcing”the investigation and evaluation work in the form of government procurement of social services and establish the specialized schools.
