浅析互联网平台型企业的反垄断法律规制

摘　　要：互联网平台企业因其网络效应和交易习惯的养成有别于传统市场,当其配以限制交易、掠夺性定价、平台强制“二选一”等滥用市场支配地位的行为时,极易形成巨无霸型平台企业,并带来差别待遇、滥用数据等诸多垄断后的危害结果。更深层的负面影响还包括资本无序扩张、加剧行业内甚至整个社会的两极分化。当前反垄断法律规制在互联网平台领域既存在包括传统反垄断法规与数字平台经济的新兴商业模式契合度不相吻合,也存在监管的执法技术薄弱导致误伤优质平台企业进而破坏行业创新等问题。因此,在新的《中华人民共和国反垄断法》出台之际,反垄断监管技术能力的短板尚未补齐之前,保持相对包容审慎的监管态度,有利于在约束互联网行业公平发展的同时兼顾反垄断规制的准确性.Internet platform enterprises are different from traditional markets because of their network effects and trading habits.When it is accompanied by behaviors that abuse market dominance,such as restricting transactions,predatory pricing,and forcing platforms to choose one of the two,it is very easy to form a giant platform enterprise,and bring about many harmful consequences after monopoly,such as differential treatment and abuse of data.The deeper negative effects also include the disorderly expansion of capital and the polarization of the industry and even the whole society.At present,in the field of Internet platform,the antimonopoly legal regulation not only has the inconsistency between the traditional anti-monopoly law and the emerging business model of the digital platform economy,but also has the problem that the weak law enforcement technology of supervision leads to the injury of high-quality platform enterprises and the destruction of industry innovation.Therefore,at the time of the introduction of the new Anti-Monopoly Law of the People's Republic of China,maintaining a relatively inclusive and prudent regulatory attitude before the technical capacity of anti-monopoly supervision is enhanced is conducive to the accuracy of anti-monopoly regulation while constraining the fair development of the Internet industry.
