摘　　要：作品类型与作品独创性之间存在内在关联。作品类型是作品独创性的类型化呈现方式,作品独创性是生成作品类型的决定性因素。作品类型为阐明作品独创性提供必要场景,作品类型为描述作品独创性提供适格路径,是独创性抽象叙事的相对具体化。开放的作品类型体系是作品独创性逻辑延伸的结果,作品类型体系的开放性是作品独创性“主体性”特质和“创造性”特质的要求。法律示例的作品类型是作品独创性判定的辅助条件,示例的作品类型可以提示作品独创性判定的方向,提供差异化的独创性判定思路。应当以合乎作品独创性的展开逻辑为原则、以优化具体要素的配置为手段来改进著作权法中作品类型的示例方式。法律未示例的作品是作品独创性判定的适格对象。在适用“符合作品特征的其他智力成果”兜底条款时应当厘清未示例作品与示例作品类型之间的关系,以作品独创性判定的内在逻辑引领兜底条款的适用,以作品的领域限定要件作为作品独创性判定的前提,对“作品特征”进行全面考察。narrative.The open type system of works is the result of the logical extension of the originality of works,and the openness of the type system of works is the requirement of the"subjectivity"and"creativity"of the originality of works.The works types of legal examples are the auxiliary conditions for the judgment of originality of works,which can suggest the direction of the judgment of originality of works and provide differentiated ideas for the judgment of originality.We should improve the example of the type of works in the copyright law by optimizing the allocation of specific elements in accordance with the principle of the expansion logic of the originality of works.The unexampled works are qualified objects of the judgment of the originality of works.When applying the miscellaneous provision of"other intellectual achievements conforming to the characteristics of the works",the relationship between the unexampled works and the type of the exampled works should be clearly defined,the internal logic of the judgment of the originality of works should guide the application of the miscellaneous provision,and the prerequisite of the judgment of the originality of works should be the limited elements of the field of works,and a comprehensive examination of the"characteristics of the works"should be conducted.
