摘  要:通过私主体履行行政任务并非给付行政的专属,其同样也是履行秩序行政任务的手段。基于行政法上的第三方义务理论,由物业服务企业承担住宅区的火灾预防义务,兼具合理性和合法性。在消防体系中,物业服务企业的法律地位具有双面性,既是提供协助的私主体,又是受到监管的私主体。由于物业服务企业不具备实施强制力的公权,仅具有劝阻、报告的管理权限,行政机关的监管职权与法律责任不完全适配,火灾预防事项存在公私权责不平衡的问题,建议从三方面进行优化设计。The performance of administrative tasks through private entities is not only a means of performing administrative tasks of payment,but also is a means of performing administrative tasks of order.Based on the theory of third-party obligations in administrative law,it is reasonable and legal for property management service enterprises to assume the obligation of fire prevention in residential areas.In the fire protection system,the legal status of property is two-sided,and it is both a private subject that provides assistance and a private subject that is subject to supervision.Because the property does not have the public power to implement coercive force,only has the management authority to dissuade and report,and the regulatory authority and legal responsibility of the administrative organ are not fully adapted,so there is an imbalance between public and private rights and responsibilities in fire prevention matters,and it is recommended to optimize the design from three aspects.
