思想史中的“商鞅学案”及其当下意义

摘　　要：法治中国条件下,“商鞅学案”问题值得认真对待。依据历史事实,客观评价商鞅思想,是批判和继承传统法文化的前提。但由“驭民五术”所引发的商鞅污名化现象,对“商鞅学案”研究造成干扰。《商君书》的有关术语经过附会化阐释,被曲解成一种邪恶的统治术。学术界也存在某种贬低商鞅思想的情绪,这有失偏颇。任由商鞅的污名化发展下去,当下与传统之间的心理纽带被淡化,可能陷入法律文化领域的空心化。我们需要从学术公案的角度,重新评价商鞅思想,消解这种法律文化中的隐忧。It deserves us to take the ShangYang Academic Case seriously in the condition of the rule of law in China.An objective evaluation of the idea of Shang Yang based on historical facts is a prerequisite for criticizing and inheriting traditional legal culture.However,the Five Trickeries to control the people,which causes the Stigmatization of ShangYang,has become an obstacle to the research of the ShangYang Academic Case.Some terminologies of The Lord ShangYang's Collectives has been misinterpreted as a kind of evil domination technique after being interpreted in an epithetical way.There is also a certain tendency in the academic world to belittle the idea of Shang Yang,which leads to injustice.If the stigmatization of Shang Yang is allowed to continue,the psychological bond between the present and the tradition will be diluted,and we may fall into the hollowing out of the field of legal culture.We should eliminate the hidden worries by reestimating ShangYang's thought in the angel of the academic case.
