困囿与出路:东盟跨境雾霾治理的国际软法运用之道

摘　　要：从20世纪90年代至今,东盟跨境雾霾污染循环往复并备受关注。雾霾治理关键领域的国际硬法缺位与创制成本高昂使得东盟“零雾霾”战略目标任重道远。国际软法凭借拓宽国际法律渊源、灵活性高等多维价值功能成为东盟在跨境雾霾治理中的较优选择。但鉴于现阶段国际软法的关键弱点掣肘于雾霾治理规则碎片化、软法保障机制不济与集体治理行动受阻的困囿,东盟各方应不断探寻优化路径。可通过调整国际软法实施保障机制、推进国际软法硬法衔接适用、深化各国跨境雾霾治理能力建设与合作。此外,东盟应在“人类命运共同体”视域下充分挖掘跨境雾霾国际软法的治理潜能,实现国际软法治理路径的升级和嬗变。Since the 1990s,cross-border haze pollution in ASEAN has been cycled repeatedly and attracted much attention.The absence of international hard law in the key areas of haze governance and the high cost of creation make the strategic goal of“zero haze”of ASEAN a long way to go.International soft law has become a better choice for ASEAN in cross-border haze governance by broadening the sources of international law,high flexibility and other multi-dimensional value functions.However,in view of the fact that the key weaknesses of international soft law at this stage are limited by the fragmentation of international soft law system,the ineffectiveness of soft law safeguard mechanism and the hindrance of collective governance action,all parties in ASEAN should constantly explore the path of optimization.We can adjust the implementation guarantee mechanism of international soft law,promote the convergence and application of international soft law and hard law,and deepen the capacity-building and cooperation of cross-border haze governance among countries.In addition,ASEAN should fully tap the governance potential of cross-border haze international soft law from the perspective of“community with a shared future for mankind”and realize the upgrading and evolution of international soft law governance path.
