摘　　要：【目的】提升微生物相关专利保护水平,推动微生物学研究和微生物专利法律制度的发展,为今后保藏编号限定的微生物专利侵权案件审判思路提供参考。【方法】统计我国用于申请专利的保藏微生物寄存量与保藏编号限定的微生物专利申请量,深入讨论我国保藏编号限定的微生物专利侵权判定规范来源和现实困境。【结果】我国专利微生物保藏量和保藏编号限定的微生物专利申请授权量均居世界第一位,但其侵权判定问题缺乏深入讨论。【结论】为给予微生物发明专利权人更为完善的保护,需要从对以保藏编号为技术特征的微生物本身专利做扩大解释、在司法实践中创新鉴定方法及在审判中适用等同原则三个方面入手,突破现有侵权判定困境。[Purposes]This paper aims to improve the level of microbial-related patent protection,promote the development of microbiology research and the legal system of microbial patents,and provide reference for the trial of microbial patent infringement cases limited by deposit number in the future.[Methods]The number of deposited microorganisms used for patent application and the number of microbial patent applications limited by deposit numbers in our country were counted,and the source and practical dilemma of the determination standard of microbial patent infringement limited by deposit numbers in our country were deeply discussed.[Findings]Both the quantity of patent microorganism deposit and the number of microbial patent application authorization in China rank first in the world,but the issue of infringement determination is lack of in-depth discussion.[Conclusions]In order to provide more comprehensive protection for microbial invention patent holders,it is necessary to start from three aspects:expanding the interpretation of microbial patents with preservation numbers as technical features,innovating identification methods in judicial practice,and applying the principle of equivalence in trials,in order to break through the existing dilemma of infringement judgment.
