摘　　要：人工智能在庭审中的运用是科学技术发展的必然,人工智能在庭审质证中已有诸多运用,主要包括在线质证的数智化管理、生成用于质证分析报告、评估庭审证据的真实性。然而,当前人工智能在庭审质证中也面临质证数据可靠性不足、算法的可解释性不强、数据隐私安全性不高等挑战,这些挑战极大地限制了人工智能的适用空间。人工智能在庭审质证中的运用需落实司法价值平衡原则、人工智能辅助原则、技术标准保障原则,并贯彻于人工智能运用的全流程。为了克服人工智能在庭审质证中的挑战,应当做到保障质证数据的可靠性、强化算法的可解释性和提高数据隐私的安全性。The use of artificial intelligence in court trials is a product of the development of science and technology.Artificial intelligence(AI)has been used in many cross-examinations in court,whose functions mainly involve the digital management of online cross-examination,the generation of data and reports to be used for cross-examination analysis,and the assessment of the authenticity of evidence in trial.However,artificial intelligence in cross-examination in court is also facing the challenges of insufficient reliability of examination data,poor interpretability of algorithms,and poor data privacy and security,which greatly limit the applicability of artificial intelligence therein.The use of artificial intelligence in cross-examination in court needs to follow the principles of balance of judicial value,ancillary support of artificial intelligence,and guarantee of technical standards so as to ensure that the whole process of the use of artificial intelligence proceeds smoothly.In order to overcome the challenges of AI-assisted cross-examination in court,the reliability of the examination data,the interpretability of the algorithm,and the security of data privacy should be guaranteed.
