摘　　要：随着信息技术的广泛应用,法治政府建设进入数字时代。数字治理遵循“技术—制度—价值”逻辑,形成三维主体间的互构关系,与数字时代的行政执法改革具有契合性。当前,行政执法改革实现部分目标,但技术层面存在数据壁垒与数字形式主义,制度层面出现综合与专业的张力、权力与能力的悖离,价值层面产生公共利益与公民权利保护等原定目标出现一定异化,对技术赋能制度、制度实现价值、价值形塑技术产生阻碍。需要以数字治理为引领破解行政执法改革困境,通过统一数据标准和集约建设一体化平台,基于需要的整体主义助力有限度的执法体制改革,推进公民参与和监督执法,实现技术、制度与价值的相互构建,完成数字时代行政执法转型升级。同时,应谨慎对待数字时代行政执法改革中的新挑战,促进数字治理与行政执法改革协同演化。With the widespread application of information technology,the construction of rule of law has entered the digital age.Digital governance follows the logic of"technology-institution-value",forming a threedimensional binary mutual construct relationship,which is compatible with the administrative law enforcement reform of the digital age.At present,administrative law enforcement reform has achieved some goals,but at the technological level,there are data barriers and digital formalism;at the institutional level,there are tensions between comprehensiveness and professionalism,and divergence of power and capability;at the value level,there is a dual imbalance between public interests and citizen rights protection.This hinders the mutual connection of technology empowerment institutions,institutional realization of value,and value shaping technology.We need to use digital governance to guide the resolution of the dilemma of administrative law enforcement reform,unify data standards and intensively build an integrated platform,based on the need for holistic support for limited law enforcement system reform,promote citizen participation and supervision of law enforcement,and achieve mutual construction of technology,institutions,and values to complete the transformation and upgrade of administrative law enforcement in the digital age.At the same time,we should treat the new issues and challenges in the reform of administrative law enforcement in the digital age with caution,and promote the co-evolution of digital governance and administrative law enforcement reform.
