大学生创业就业中的知识产权犯罪风险防控——基于湖州市吴兴区人民检察院的视角

摘　　要：就业是大学生从学校走向社会的重要环节,也是大学生职业生涯的起点。大学生社会经验欠缺、知识产权意识薄弱,有必要从检察院视角对大学生创业就业中的知识产权犯罪风险作出提示。针对存在的理论研究滞后、教育与实践脱节、风险防范意识欠缺、现实案件错综复杂等问题,检察院应积极探索完善知识产权刑事案件取证制度,加强知识产权理论教育与实践的结合,分离处理知识产权刑民交叉案件,鼓励大学生参与知识产权自诉案件,推动党建与数字检察同向发力。从而引导大学生合法创业就业,避免知识产权犯罪风险,推动经济社会高质量发展。Employment is an important link for college students from school to society,and it is also the starting point of college students’career.As college students lack social experience and have weak awareness of intellectual property rights,so it is necessary to make suggestions on the risk of intellectual property crimes in college students’employment and entrepreneurship from the perspective of procuratorate.For the problems that exist nowadays such as lagging behind in theoretical research,disconnection between education and practice,lack of awareness of risk prevention,and complexity of real cases,it is necessary for procuratorate to perfect the system of criminal cases of intellectual property rights,strengthen the education of the combination of intellectual property rights theory and practice,handle intellectual property criminal and civil cases separately,encourage college students to participate intellectual property cases of private prosecution,promote the applying force of both the Party Construction and digital prosecution in the same direction,so as to lead college students to legitimate employment and entrepreneurship to avoid risks of intellectual property crimes,and promote economic and social development with high quality.
