无证行医案件法律竞合分析

摘　　要：2020年6月1日《基本医疗卫生与健康促进法》(以下称《健康促进法》)施行,2022年3月1日《医师法》施行,2022年5月1日新《医疗机构管理条例》施行,由此对2020年6月1日之前发生的连续性无证行医行为,查处时将涉及2016版《医疗机构管理条例》《执业医师法》《健康促进法》《医师法》及2022版《医疗机构管理条例》的适用;不论是《医师法》《健康促进法》等同时有效的法律之间的竞合,还是违法行为跨越《医师法》《执业医师法》等新旧法时的法律适用,都是无证行医查处中经常涉及的难题。以模拟案例探讨各种情形下的法律适用。The Health Promotion Law came into effect on June 1,2o2o.The Doctors Law came into effect on March 1,2022.The new version of Management Regulation of Medical Institutions came into effect on May 1,2022.It will involve the application of the 2016 edition of Management Regulation of Medical Institutions,the Practicing Doctors Law,the Health Promotion Law,the Doctors Law and the 2022 edition of Management Regulation of Medical Institutions when Investigating and dealing with continuous unlicensed medical practice which happened before June l,2020.Whether it is the competition between the simultaneously effective laws such as The Doctors Law and The Health Promotion Law,or the application of laws when illegal acts cross the old and new laws such as The Doctors Law and The Practicing Doctors Law,these are often involved in the investigation and handling of unlicensed medical practice,this paper discusses the application of law in various situations with a simulated case.
