摘 要:近现代监察派驻机构历来是学界关注的重要议题之一。通过历史梳理后不难发现,政治诉求、改革驱动、外部冲击和具体事件等因素的综合作用推动了近现代中国监察派驻机构的变革,形成其发展演进的迟缓性、改良性和断点性等特点,也客观造就了派驻监督不受重视、机构设置不够合理、缺乏有效监督制约等局限。然而,即便如此,作为古代与当代衔接转型的近现代监察派驻机构对监察法的创新、二元行诉模式的摸索和边区纪检监察派驻机构的局部探索等方面的积极意义与当代启示是值得肯定的。The modern procuratorial representative agency has always been one of the important topics of academic attention.Through combing its history,it is not difficult to find that such factors as political demands,reform drives,external impacts,and specific events jointly promoted the reform of procuratorial representative agencies in modern China.Its evolution was slow,reformative,and discontinuous,which resulted in some limitations,such as the neglect of stationed supervision,unreasonable institutional setup,and lack of effective supervision and control.However,as a transition between ancient and contemporary times,modern procuratorial representative agencies are of positive contemporary significance for the innovation of supervision laws,the exploration of the dual prosecution model,and the local exploration of the disciplinary inspection and procuratorial representative agencies in the border areas.
