摘　　要：建构中国自主法学知识体系,是社会法治实践发展到一定历史阶段的理论要求,同时也是基于对近代以来一味仿效西方法学知识的历史检讨而提出的。近代法律改革的过程中,虽然中国法学知识体系的建构者有一定的主体自觉,但近代中国法律深受外来性、超前性之困。传统法律文化可以为建构中国自主法学知识体系提供史鉴,更为新的法学知识体系何以“中国”、如何“自主”提供重要方向标,建构自主法学知识体系应认真对待传统法律文化。在法学知识传承与创新的过程中,法律史学科至少有三重学术责任:其一,“讲清楚”中华传统法律文化的发展脉络,阐释中华优秀传统法律文化的基本精神;其二,在理论上“能贯通”传统与现代的法学知识,为自主法学知识体系提供理论资源;其三,在服务于社会主义法治实践的过程中“致于用”,实现优秀传统法律文化的创造性转化、创新性发展。建构中国自主法学知识体系是多学科共同的学术任务,法律史学人应与其他法学学科紧密协作,法律史学自身亦是开放性学科。The construction of China’s Independent Knowledge System of Law is a theoretical requirement for the development of social practice of the rule of law to a certain historical stage,and it is also based on the historical review of the imitation of Western jurisprudential knowledge since modern times.In the process of modern legal reform,although the constructors of the Chinese legal knowledge system had a certain degree of subjective self-awareness,modern Chinese law was deeply troubled by exoticism and being ahead of its time.Traditional legal culture can provide a historical reference for the construction of China’s Independent Knowledge System,and more importantly,it provides an important direction for the new legal knowledge system to be“China’s”and“independent”,and the construction of China’s Independent Knowledge System should take the traditional legal culture seriously.In the process of inheritance and innovation of legal knowledge,the discipline of legal history has at least three academic responsibilities:firstly,to“make clear”the development of traditional Chinese legal culture and to explain the basic spirits of the excellent traditional Chinese legal culture;secondly,to“be able to connect”traditional and modern legal knowledge,and provide theoretical resources for the independent legal knowledge system;thirdly,it“can be used”in the process of serving the practice of Socialist rule of law,and realize the creative transformation and innovative development of the excellent traditional legal culture.The construction of China’s Independent Knowledge System is a common academic task of many disciplines,and scholars of legal history should work closely with other legal disciplines,and legal history itself is also an open discipline.
