AIGC环境下知识生产的分配正义与产权重构

摘　　要：由人类提供创意构思、机器自主完成表达呈现的人机混合创作正在成为人类知识生产的主要方式,但各方对AIGC产权归属分歧巨大,严重制约了权益保护与产业发展。文章认为分歧的深层原因并不在于各方对人类智力投入的定性差异上,而在于对知识产权的制度功能存在认识误区。破解问题的关键在于正视知识生产的社会性以及知识产权对社会性生产的利益分配功能,从生产转型层面重建AIGC环境下知识生产的分配正义。由于人类创作与人机混合创作在利益保护上存在原则性冲突,文章提出在知识产权体系中增设与版权并列的新权利类型,对AI知识生产中的人类智力投入提供专门化的保护。The hybrid creation by humans and machines,where humans provide creative ideas and machines autonomously complete the expression and presentation,is becoming the main mode of human knowledge production.However,there is a significant divergence in opinions regarding the ownership of AIGC(AI-generated content),which severely restricts the protection of rights and the development of the industry.This paper argues that the deep-seated reasons for these divergences are not due to differences in these categories determining the rights of human intellectual contributions,but rather a misunderstanding of the institutional function of intellectual property rights.The key to solving these issues lies in acknowledging the social nature of knowledge production and the function of intellectual property rights in distributing benefits within social production,thereby reconstructing the distributive justice of knowledge production in the AIGC environment from the perspective of production transformation.Based on the principled conflict between human creation and hybrid human-machine creation in terms of interest protection,this paper proposes the establishment of a new type of right within the intellectual property system,which is parallel to copyright,to provide specialized protection for human intellectual contributions in AI knowledge production.
