摘 要:促进农民工在共建共享中实现全面发展,是党中央“促进公平正义、增进人民福祉”的必然要求。基于上海市2015~2020年4858个微观样本,以健康作为福祉的替代变量,实证分析了劳动合同约束力、劳动保护对农民工福祉的影响及其作用机理。研究发现:(1)84.64%的农民工与其雇佣者签订了某种形式的合同,表明《劳动合同法》的颁布与推行推进了农民工市场劳资关系法制化以及合同签署的规范化。24.68%的农民工获得了雇佣企业为其购买“五险一金”,36.25%的农民工所在企业严格遵守工时制度,56.98%的农民工获得了雇佣企业为其提供餐饮补贴,表明我国劳动保护制度执行情况有待提高。(2)农民工所签劳动合同的法律约束力越强,则其所在企业具有更显著的动机切实执行劳动保护制度。在合同约束力促进农民工福祉水平提升过程中,劳动保护制度起到了显著的中介作用。社会保险、工时制度和生活福利3个方面的劳动保护制度,均会显著提升农民工福祉水平。(3)进一步的异质性分析发现,上述现象在受教育水平较低、受雇于服务行业、来自于制度质量水平较低地区的农民工样本中更为显著。本研究对于促进农民工福祉的提升乃至中国实现社会公平正义的目标具有重要意义。Promoting the all-round development of migrant workers through joint contribution and shared benefits is the inevitable requirement of the Communist Party of China(CPC)Central Committee to"promote fairness and justice and improve the people's well-being".Based on 4858 micro-samples from 2015~2020 in Shanghai,we empirically analyze the impact of binding labor contracts and labor protection on migrant workers'well-being and its mechanism of action,using health as a proxy variable for well-being.The results show that:(1)84.64%of migrant workers have signed some form of contract with their employers,which indicates that the promulgation and implementation of Labor Contract Law has promoted the legalization of labor relations in migrant workers market and the standardization of contract signing.24.68%of migrant workers obtained"five social insurance and one housing fund"from employers,36.25%of migrant workers'employers strictly abide by the working hour system,and 56.98%of migrant workers obtained catering subsidies provided by employers,indicating that the implementation of labor protection system in Chinese enterprises needs to be improved.(2)The stronger the legal binding force of the labor contract signed by migrant workers,the more obvious the motivation of the enterprises they work for to implement the labor protection system.Labor protection system plays a significant intermediary role in the process of legally binding contracts signed by migrant workers to promote the improvement of migrant workers'well-being.The three aspects of labor insurance system,namely social insurance,working hour system and living welfare,will significantly improve the well-being level of migrant workers.(3)Heterogeneity analysis shows that the above phenomenon is more obvious in the sample of migrant workers with lower education level,employed in the service industry and from areas with lower level of institutional quality.This study is of great significance to the improvement of migrant workers'well-being and the realization of soci
