重大疫情背景下的建设工程项目索赔问题分析

摘　　要：新冠肺炎疫情是重大突发卫生公共事件,属于不可抗力事件。疫情紧急防控措施影响下的工程项目在进度和造价管理等方面发生重大变化,工程索赔问题凸显。针对重大疫情背景下的工程索赔主体责任不明,索赔内容复杂,索赔费用和顺延工期核算困难等问题,文章从造价咨询和管理的角度,梳理和分析了所涉及工程索赔的依据及内容。以北京市为例,基于工期索赔的时间区间特征,将工程索赔区划分为封控区、管控区和防范区,疫情背景下的工程费用索赔划分为疫情防控应急措施费、停工损失费、窝工降效费、赶工措施费和其他费用几个方面,并在此基础上,阐述了工程索赔顺延工期调整和费用调增等问题的具体核算方法。基于重大疫情背景下的工程项目索赔问题计算方法可为近似案例索赔提供借鉴和参考。The outbreak of Covid-19 event is a major health emergency public event and is a force majeure event.Significant changes have occurred in the progress and cost management of engineering projects under the influence of the epidemic's emergency prevention and control measures,and the problem of engineering claims has come to the fore.In view of the unknown responsibility of the main body of engineering claims in the context of the major epidemic,the complexity of the content of the claims,and the difficulty in accounting for the claimed costs and deferred work periods,etc.,from the perspective of cost consulting and management,we sorted out and analyzed the bases and contents of the engineering claims involved.And take Beijing as an example,combined with the Beijing regional policy,based on the time interval characteristics of the duration of the claim,the engineering claim zoning into the sealing and control area,control area and preventive area,the epidemic background of the engineering cost claim is divided into the epidemic prevention and control of contingency measures,stoppage of loss costs,nesting efficiency costs,catching up with the work of the cost of measures and other costs of several aspects,and based on this,describes the engineering claim deferred schedule adjustments and the cost of adjusting the increase and other issues of the specific accounting method.The analysis of engineering project claims based on the background of major epidemics can provide lessons and references for similar case claims.
