摘　　要：有关海盗犯罪的研究仍然存在着研究视角单一化、应对措施的建议实践可能性不高的局限性。缘于此,有必要从研究视角多元化的角度尝试去分析海盗犯罪,以求探寻出一条解决实际问题的理论路径。分析海盗犯罪的“公敌性”属性以及刑法学界研究现状,可以推断出应当将海盗犯罪规制路径置于犯罪学与刑法学二元视角下探究。一方面,从犯罪学梯度的角度观之,应当将“以治为主,以罚为辅”作为基本的规制理念,同时具体到措施方面,应当做到政治领域的协商共治,经济领域的互利共荣,文化领域的和谐共生。另一方面,从刑法学梯度的角度观之,应当从刑事实体法与刑事程序法两个层面展开,就前者而言应当以国际法中的海盗罪作为行为定性标准,以国内法中的各个具体罪名作为量刑参照。至于后者层面,则应当设立国际刑事诉讼法以协调国际犯罪过程中的管辖权冲突问题。同时,在刑法学梯度的实践过程中还必须兼顾国家主权的维护问题。Through an examination of the"public enemy"attributes inherent in piracy crimes and an assessment of the current landscape within criminal law scholarship,it is deduced that the regulatory trajectory for piracy crimes should be explored within the dual framework of criminology and criminal law.From a criminological standpoint,a foundational regulatory principle should advocate"prevention as the primary focus,with punishment as a supplementary measure."This involves specific measures grounded in political negotiations and governance within the political sphere,mutual economic prosperity within the economic realm,and harmonious coexistence in the cultural domain.Conversely,within the gradient of criminal law,the analysis should unfold across the spectra of substantive criminal law and criminal procedural law.In the former,the behavioral qualification standard should be derived from international law's classification of piracy,while specific charges within domestic law should inform sentencing considerations.Regarding the latter,the establishment of an international criminal procedure law is posited to mitigate jurisdictional conflicts arising in the context of international criminality.Simultaneously,the practical implementation of criminal law necessitates a nuanced consideration of the preservation of national sovereignty.
