数字法治背景下监察留置措施的体系化构建

摘　　要：文章通过250份裁判文书的调研,收集总结了大量职务犯罪留置适用数据,发现实务中存在留置时限长、缺乏定期审查制等问题,提出构建留置体系的对策。具体而言,监察留置体系包括临时性留置、短期留置和长期留置,其中临时性留置仅需满足事实要件即可;在选择适用临时性留置和短期留置的同时附加适用非留置期间的等级式的数字化监管;对于涉嫌严重职务违法行为的被调查人只能适用临时性留置措施,同时,附加适用不同等级的数字化监管;对于涉嫌职务犯罪行为的被调查人可以依社会危险性的大小选择适用三种留置措施;案情重大、复杂型案件可以适用长期留置,存在妨碍风险型案件只能适用短期留置,期限届满审查三要件的变化;反向衔接一般情况下留置措施不宜逆向介入。Through a survey of 250 judicial documents,a large amount of data on the application of retention for duty crimes was collected and summarized.It was found that there are problems in practice such as long retention periods and a lack of regular review system,and countermeasures for constructing a retention system were proposed.The retention system includes temporary retention,short-term retention,and long-term retention,and temporary retention only needs to meet the factual requirements.When choosing to apply temporary and short-term retention,it is required to add hierarchical digital supervision for non-retention periods.The investigated individuals suspected of serious job violations can only be applied temporary retention measures,and different levels of digital supervision are also applicable.The investigated person suspected of committing a duty crime can choose to apply three types of detention measures based on the degree of social danger.Long term retention can be applied to cases with significant and complex circumstances,while short-term retention can only be applied to cases with obstructive risks.Changes in the three elements of expiration review are necessary.Under normal circumstances,reverse intervention is not advisable for retention measures.
