摘　　要：明确农村集体经济组织法人侵权责任的承担,有助于为实现乡村振兴保驾护航。农村集体经济组织因其符合民事主体的设计原理与实际需求,适合赋予权利能力,相应地也具有行为能力与侵权责任能力。集体土地所有权不能纳入责任财产范围,因而农村集体经济组织不具有破产能力。对于职务侵权行为,应摒弃代理与代表区分思维,不区分法定代表人抑或其他执行人员。基于平衡农村集体经济组织法人、执行职务人员与被害人三方的利益考量,应明确区分外部关系与内部关系。对外部关系而言,农村集体经济组织法人与执行职务人员应共同对被害人负连带责任。对内部关系而言,应以执行职务人员的过错程度确定最终的责任归属。Clarifying the legal person's liability for infringement in rural collective economic organizations can help safeguard the realization of rural revitalization.Rural collective economic organizations,due to their compliance with the design principles and practical needs of civil subjects,are suitable for empowering rights,as well as possessing capacity for behavior and tort liability.Collective land ownership cannot be included in the scope of responsible property,therefore rural collective economic organizations do not have the ability to go bankrupt.For acts of duty infringement,the thinking of distinguishing between agents and representatives should be abandoned,without distinguishing between legal representatives or other enforcement personnel.Based on the consideration of balancing the interests of legal persons,personnel performing duties,and victims in rural collective economic organizations,a clear distinction should be made between external and internal relationships.In terms of external relations,the legal persons of rural collective economic organizations and the personnel performing their duties should jointly bear joint and several responsibilities towards the victims.For internal relationships,the ultimate responsibility should be determined based on the degree of fault of the personnel performing their duties.
