摘 要:为助力高质量共建“一带一路”倡议,我国创设了国际商事法庭,以之为平台形成了集诉讼、调解和仲裁为一体的多元化争端解决集约机制。但国际商事法庭还存在多元化解纠纷程序衔接不畅、审级制度限制当事人上诉救济、管辖范围较窄及国际商事专家委员会功能不彰等问题。应立足我国发展实践,对接国际条约标准,借鉴域外经验,以明确专家委员会专职调解员的地位为基础,促进诉、仲、调的有效衔接;以更加侧重服务当事方的诉讼咨询为定位,化解上诉救济矛盾;以构建类型化管理的专家委员会工作小组为路径,扩大国际商事法庭管辖范围,充分释放国际商事专家委员会这一创新制度的效能。In order to help jointly build the“the Belt and Road Initiative”with high quality,China has created the International Commercial Court,which has formed a diversified and intensive dispute settlement mechanism integrating litigation,mediation and arbitration.The international commercial court also has many problems,such as the poor connection of diversified dispute resolution procedures,the trial level system restricting the parties appeal relief,the narrow jurisdiction and the weak function of the international commercial expert committee.We should base ourselves on China's development practice,connect with international treaty standards,learn from foreign experience,and promote the effective connection of litigation,arbitration and mediation on the basis of clarifying the status of full-time mediators of experts committee.The litigation consultation with more emphasis on serving the parties is positioned to resolve the contradiction of appeal relief.In addition,we should expand the jurisdiction of the International Commercial Court and fully release the effectiveness of the innovative system of the International Committee of Commercial Experts.
