清代盛京刑部司法审判职能研究述评

摘　　要：盛京刑部是清廷于陪都盛京设置的重要理刑机构,主要掌管盛京区域涉及旗人的案件。关于盛京刑部、清代司法审判机构以及清代东北地区司法问题的研究虽已形成一定的成果,但未对盛京刑部的司法审判职能详细展开研究。另外,已有的研究也未能完全揭示其在地方司法体系中的地位与作用,清代东北的审级问题更是未能得到准确结论。盛京刑部在清代盛京地区司法审判中的作用,盛京刑部作为清代地方司法体系中特殊一环,如何通过司法审判来维护盛京地区的社会秩序等问题,都没有得到全面且准确的解答。The Shengjing Ministry of Justice was an important legal enforcement institution set up by the Qing government in Shengjing,mainly in charge of cases involving bannermen in the Shengjing area.Although the research on the Shengjing Ministry of Justice,the judicial trial institutions of Qing Dynasty,and the judicial issues in the northeast region of Qing Dynasty has produced certain results,no research has been able to carry out a detailed study on the judicial trial functions of Shengjing Ministry of Justice.In addition,the existing research has not been able to fully reveal its status and role in the local judicial system,let alone the problem of trial level in the northeast of Qing Dynasty.Questions such as the role of Shengjing Ministry of Justice in the judicial trials in the northeast region of Qing Dynasty and how it can maintain social order in the Shengjing region through judicial trials as a special part of the local judicial system in Qing Dynasty have not been comprehensively and accurately answered.
