摘　　要：数字藏品依托非同质化通证技术开辟新型交易模式的同时,也造成了著作权法适用争议。适用发行权的理论主张没有解释论正当性和立法论必要性,损害赔偿计算标准发行权化缺乏实证法支撑。数字藏品侵权损害赔偿既存在着一般信息网络传播权侵权损害之实际损失难以确定的现实困境,也因新技术、新市场和产业态势而复杂化。应以市场交易机会损失为理论基础,在数字藏品市场环境下确定现实的或模拟的著作权许可使用费,再充分考虑数字藏品侵权行为的特殊性,综合侵权范围、侵权期间、点击率、浏览量、发售价格和数量以及转售次数、价格等因素予以个案考量,公允地计算侵权损害赔偿数额,维护著作权人合法权益,繁荣数字藏品交易市场。While digital collectibles rely on NFT technology to open up new transaction models,it has also caused controversy over the application of copyright law.The theoretical proposition of applying distribution rights lacks interpretive legitimacy and legislative necessity,and the standardization of compensation for damages lacks empirical legal support.The compensation for infringement damages of digital collectibles is not only difficult to determine the actual losses of general make available rights infringement damages,but also complicated by new technologies,new markets,and industrial trends.The theoretical basis should be based on the loss of market trading opportunities,and the actual or simulated copyright licensing fees should be determined in the digital collectibles market environment.Then,the particularity of digital collectibles infringement behavior should be fully considered,and factors such as the scope of infringement,infringement period,click through rate,browsing volume,selling price and quantity,as well as resale frequency and price should be considered on a case by case basis.The amount of compensation for infringement damages should be fairly calculated to protect the legitimate rights and interests of copyright owners,and promote the prosperity of the digital collectibles trading market.
