摘 要:在国家治理现代化的背景下,犯罪治理应坚持以人民为中心的治理立场、多元主体参与的治理格局、基层化解矛盾的治理场域。在犯罪治理变革中,基层自治组织的充分参与,既是适应犯罪现象内部结构变化的趋势,亦是契合“国家·社会”双本位的犯罪治理模式,还是基于基础自治组织先天优势的考量。因此,可以从三个方向演进基层自治组织的犯罪治理职能,即强化犯罪预防职能、提高在刑事和解中的地位、搭建社区矫正的协调平台。In the context of the modernization of national governance,the reform of criminal governance should adhere to the people-centered governance position,the governance pattern with the participation of multiple subjects,and the governance field of resolving conflicts at the grass-roots level.In the reform of crime governance,grassroots self-governing organizations have a full logic of participation,which is not only to adapt to the changes of the internal structure of crime phenomenon,but also to fit the crime governance model with the dual standard of“state-society”,or based on the innate advantages of basic self-governing organizations.Therefore,the crime governance functions of grassroots autonomous organizations can evolve in three directions:enhancing the crime prevention function,elevating their role in criminal reconciliation,and establishing a platform for coordinating community corrections.
