生态环境部门“统一监督管理”条款的解释论展开——以《环境保护法》第10条第1款为中心

摘　　要：在环境管理的横向关系上,“统一监督管理与分部门管理相结合”的职能分工构成我国环境保护监管体制的制度基础。考察“统一监督管理”条款的脉络,回顾其内在演进逻辑,在解释论视角下明辨其在文义解释、体系解释、目的解释中存在的具体问题,可知该条款存在规范用语模糊、内部规则冲突、适用功能失位等弊病。为实现统管条款职责的充分履行,可将该条款释义至业务指导、综合协调、同级监督三个向度,并通过明确“统一监督管理”职责的履行程序、保障生态环境部门统一监管执法能力、搭建统管条款下的部门履职问责机制等措施,强化该条款中职责履行的施策方向。Regarding the horizontal relationship of environmental management,the functional division of labor of“unified supervision and management combined with departmental management”forms the institutional basis of China’s environmental protection supervision system.If we follow the context of the"unified supervision and management"clause,review the internal evolutionary logic of this clause,identify the specific problems in its literal interpretation,system interpretation,and purpose interpretation from the perspective of interpretation theory,and analyze the unified management clause,it is easy to find shortcomings such as vague normative terminology,conflicting internal rules,and misplaced applicable functions.To achieve full fulfillment of the responsibilities of the unified management clause,this clause is supposed to be interpreted to include three dimensions:professional guidance,comprehensive coordination,and peer supervision.The unified supervision and law enforcement of the ecological environment department should be ensured by clarifying the performance procedures of the“unified supervision and management”responsibilities.An accountability mechanism for department performance under the unified management clause should be established so as to ensure the policy direction for the performance of responsibilities.
