拟制血亲亲子关系司法解除的困境因由和路径优化

摘　　要：拟制血亲亲子关系与自然血亲亲子关系承载相同的法定权利义务和社会期待的养老育幼功能。然而,不同于自然血亲亲子关系,拟制血亲亲子关系恶化到父母子女无法共同生活时,可以通过诉讼解除关系。当前拟制血亲亲子关系包括养父母子女关系和继父母子女关系,其规制的理论依托体系欠缺,内容抽象零散,导致司法实践处理养父母子女和继父母子女关系的解除时无据可依、无章可循,类案异判和同案不同判现象严重。当前纠纷主要集中在子女成年后,可分为三类:养父母子女关系解除、继父母子女关系解除、关系解除后的经济补偿的标准。婚姻、收养、继承等相关规定法典化后,亟待在体系视域和家庭价值引导下,就拟制血亲亲子关系的诉讼解除及其引致的身份和经济纠纷形成指导原则、价值导向和具体规则,优化司法解决路径。The blood parent-child relationship in fiction of law carries the same legal rights and obligations and socially expected function of supporting the elderly and the young as the natural blood parent-child relationship.However,unlike the natural blood parent-child relationship,the fictional blood parent-child relationship can be dissolved through litigation when it deteriorates to the point where the parents and children cannot live together.Currently,the blood parent-child relationship in fiction of law includes relationship between adoptive parents and adopted children and relationship between stepparents and stepchildren.The theoretical system on which its regulations are based is lacking,and its content is abstract and fragmented.As a result,judicial practice has no evidence or rules to follow when dealing with the dissolution of the relationship between adoptive parents and adopted children and stepparents and stepchildren.The phenomena of different judgments in similar cases and different judgments in the same cases are serious.Current disputes occur mainly when children reach adulthood and can be categorized into three types:the dissolution of the relationship between adoptive parents and adopted children,the dissolution of the relationship between stepparents and stepchildren,and the criteria for financial compensation following the dissolution of the relationship.After the codification of the relevant provisions on marriage,adoption,inheritance,etc.,it is urgent to form guiding principles,value orientations and specific rules on the dissolution of litigation of the blood parent-child relationship in fiction of law and the resulting economic disputes under the guidance of the system perspective and family values,so as to optimize the path of judicial settlement.
