刑法中“论处”规定的类型化解释

摘　　要：对刑法条文中“以……论处”规定的理解,关涉罪与非罪、此罪与彼罪的认定。“论处”条款赋予某一法律事实与另一事实相同的效果,包括定罪与量刑两个方面,并且具有注意规定或法律拟制的性质,而法律拟制则具有犯罪构成的定型功能。然而“论处”条款的设置却存在拟制不当和过度类型化的问题。因此,要从方法论角度,将相互包含、补充的类型思维与概念思维应用于“论处”条款的拟制和司法实践当中,通过回归概念背后的原型,厘清类型中的核心要素与变量要素,对“论处”的具体情形作出恰当的类型化解释;同时从形式和实质两个层面对“论处”规定类型化解释的适用范围加以合理限制,使规范条文罪刑法定要求与事物本质规范评价达成一致性,从而实现论处结论的合法性、合理性和可接受性。The understanding of the provision“impose penalties based on...”in criminal law involves the determination of guilt or innocence,as well as the distinction between different offenses.The clause“impose penalties”gives the same effect to certain legal facts as to other facts,including aspects of conviction and sentencing.It also serves as a provision for attention or legal drafting,with legal drafting having the function of shaping the elements of criminal conduct.However,the setting of the“impose penalties”clause suffers from issues of improper drafting and excessive typification.Therefore,it is necessary to apply the typological thinking that encompasses and supplements each other,as well as conceptual thinking,from a methodological perspective to the drafting of the“impose penalties”clause and judicial practice.By returning to the prototype behind the concept,clarifying the core elements and variable elements in the types,appropriate typological interpretations of the specific situations of“impose penalties”can be made.At the same time,the scope of application of the typological interpretation of the“impose penalties”clause should be reasonably restricted from both formal and substantive perspectives,ensuring consistency between the normative provisions requiring punishment to be based on laws and the essential normative evaluation of the nature of the matter,thereby achieving the legality,reasonableness,and acceptability of“impose penalties”.
