双轨制下我国专利无效的必要例外创设研究

摘　　要：【目的】在我国当前专利制度下,专利权的效力状态与专利权侵权分别由专利行政部门与法院进行判断。法院无法在专利侵权诉讼中对专利权效力作出实质性的判断,使得当事人利益受到损害,应在制度上进行完善。【方法】通过援引《专利法》第20条第1款并对该一般条款的构成要件进行具体化,使得当事人能够直接在专利侵权诉讼中提出专利权滥用抗辩,从而创设出专利无效制度的必要例外。【结果】在尊重当前专利权效力审查制度的前提下,应允许通过创设必要例外的方式对专利双轨制进行一定的突破,以实现专利制度促进科技创新的目的。【结论】权利滥用抗辩在专利侵权诉讼上的适用,应以专利权存在且符合法定无效事由、客观上越出专利权界限、无法适用现有技术抗辩作为要件。[Purposes]Under China's current patent system,the validity status and infringement of patent rights are judged by the patent administration department and the court respectively.The court cannot make a substantive judgment on the validity of the patent right in the patent infringement litigation,so that the interests of the parties are harmed,and the system should be improved.[Methods]By invoking Article 20.1 of the Patent Law and concretizing the constituent elements of this general provision,the par-ties can directly raise the defense of patent abuse in patent infringement litigation,thereby creating a necessary exception to the patent invalidation system.[Findings]On the premise of respecting the cur-rent patent validity examination system,certain breakthroughs should be made in the dual-track patent system by creating necessary exceptions,so as to achieve the purpose of promoting scientific and techno-logical innovation in the patent system.[Conclusions]The application of the abuse of rights defense in patent infringement litigation should be based on the existence of the patent right and the compliance with the statutory invalidation grounds,objectively exceeding the boundary of the patent right,and the in-ability to apply the prior art defense.
