摘　　要：《民法典》优良家风条款以“家庭”为主体,明确了婚姻家庭“全方位人格”的公序良俗边界,补强了婚姻家庭法入典后的社会化表达。其可作为裁判依据和说理依据,借由司法审判的过程发挥倡导性规范的教化作用。援引优良家风条款审结的案件涵盖了正向解读和逆向解读,能够制衡婚姻家庭关系的财产法化倾向,较少出现司法裁判的异化。然而,优良家风条款的司法适用也存在泛化援引和说理不足等问题。司法机关需要明确不同情形下优良家风条款的援引规则,充分运用法律解释方法进行释法说理,并在此过程中平衡婚姻家庭秩序与个人权利保障,把握心证过程的扩张与谦抑,以此实现优良家风条款德法相融的法功能预期。The“Fine Family Traditions”clause in the Civil Code focuses on the“family”as the central entity,defining the boundaries of public order and good morals for the comprehensive development of the family.With the inclusion of marriage and family laws in the Civil Code,it strengthens the social expression of these principles.The clause serves as a foundation for judgment and reasoning in court cases and plays an educational role by promoting normative values.Cases decided under the clause tend to have less judicial alienation,encompassing both positive and negative interpretations.The core values embedded in the clause also help counterbalance the tendency towards purely property-focused laws in marriage and family relationships.However,challenges remain in the application of the clause,including potential over-application and insufficient reasoning.Courts need to establish clear guidelines for citing the clause in different cases and employ appropriate interpretive methods to strike a balance between pre⁃serving the order of marriage and family and safeguarding individual rights.It is crucial to navigate the process of evidence and rea⁃soning,ensuring the integration of morality and law,in order to achieve the intended legal function of the clause.
