论《国际刑事法院罗马规约》绿色条款的完善

摘　　要：《国际刑事法院罗马规约》中关涉环境保护的条款就是绿色条款。这些绿色条款在第8条关于战争罪的规定当中尤为明显。战争罪中的绿色条款不仅适用于国际性武装冲突,还适用于非国际性武装冲突,不仅体现了对自然环境的保护,也涵盖了对人文环境的保护。除了第8条,在第6条和第7条中也存在与环境保护相关的内容。这些绿色条款中存在一些问题,例如忽视了国家和非国家行为体造成严重环境损害的能力以及对环境保护力度低等。这些问题应当在以后的缔约国大会上予以关注和修正。The clauses of Statue of the International Criminal Court,related to environmental protection,are green ones.Article 8 is the typical green clause of the statue.Article 8 is effective during both in international armed conflicts and non-international armed ones.Not only does it show the protection of natural environment,but it displays the preserve of the cultural environment.Besides Article 8,there are also green clauses in Article 6 and Article 7.However,there are some common issues in these clauses.In the future,the assembly of state parties should pay more attention to the ability to cause serious environmental damage of states and non-state actors and the improvement of environmental protection.
