试论我国假释制度的运行困境与完善机制

摘　　要：假释是我国重要的刑罚执行变更制度,但是当前在假释适用的司法实践中假释比例过低、假释激励功能发挥不充分等问题比较突出。因此,我们有必要基于制度设计和司法实践两个层面,聚焦假释制度适用中存在的如制度不完善、衔接配合不顺畅、责任追究权责不符等堵点难题进行分析,提出有效的对策建议。从制度设计层面看,司法机关在依法适用假释制度中应坚持全面依法审查、主客观改造表现并重、严格审查证据材料、区别对待原则。在司法实践层面,通过完善考核制度、把握实体条件、完善评估标准、优化案件审理程序、制定配套保障制度、加强完善社区矫正工作等措施,以进一步促进依法适用假释制度,更好地体现宽严相济刑事政策,维护公平正义,提高司法公信力。Parole is an important system to change the execution of punishment in our country,but in the current judicial practice of parole application,the proportion of parole is too low,and the function of parole incentive is not enough.Therefore,based on the two aspects of system design and judicial practice,it is necessary to focus on the analysis of the existing problems of the application of parole,such as the imperfect system,the connection and cooperation is not smooth,and the responsibility is not consistent with the power and responsibility,and put forward some countermeasures and suggestions.From the perspective of system design,the judicial organs should adhere to the principles of comprehensive review according to law,subjective and objective transformation of performance,strict review of evidence materials and differential treatment in the application of parole system according to law.At the level of judicial practice,measures such as improving the assessment system,grasping the entity conditions,improving the evaluation criteria,optimizing the case trial procedure,formulating a supporting protection system,and strengthening the improvement of community correction work are taken to further promote the application of the parole system according to law,better reflect the criminal policy of combining leniency with severity,safeguard fairness and justice,and improve judicial credibility.
