摘　　要：鉴于国防专利司法保护案例少、缺乏成熟经验、观点不一等现状,简析国防专利与普通专利的区别,说明现实中国防专利司法保护的困境和争议的观点,分析国防专利司法保护案例,论证国防专利司法保护与侵权责任承担的正当性。国防专利制度包含相应法律规范,为司法救济侵权纠纷提供了法律依据。在国防领域内公开换保护原则符合促进国防技术发展的目的。国防专利信息交流措施为国防技术实施主体提供了履行注意义务、查阅国防专利信息、避免侵权的可能。给予国防专利司法保护,制止侵权行为,让权利人获得经济赔偿,符合公平正义的原则、国防安全的价值取向及专利法促进科学技术进步和经济社会发展的立法目的。In terms of judicial protection of national defense patent,few cases can be found with less mature experience and differing views being hold.In view of this,the present essay describes briefl y the diff erences of national defense patents from ordinary patents.It also explains the plight for judicial protection of national defense patent and the controversial views in reality,comments on the case of judicial protection of national defense patent,and expounds the justice for judicial protection of national defense patent and liability for infringement.The national defense patent system includes relevant legal norms,which provide legal basis for judicial remedy for infringement dispute.The principle of protection in turn for disclosure in the industry of national defense accords with the purpose of promoting the development of national defense technology.The measures for communication of information of national defense patent allow an entity who practices a national defense technology to fulfi ll the duty of care,check the information of national defense patents and avoid infringement.Granting judicial protection for national defense patents,injunction and compensation for economic damages accords with the tenet of fairness the value of national defense security and the legislative intent of promoting the progress of science and technology and the development of economy and society.
