摘　　要：放弃式修改是一种常见于化学领域的特殊修改方式,《专利审查指南》(2023)(以下简称《指南》)对该种修改方式仅以连续数值范围的修改为例给出了示例性指引,从而导致审查实践中对其判断规则的理解和具体操作方式存在一些含糊不清之处。文章结合具体案例,在与其他国家/地区专利局类似规定进行比较分析的基础上,对《指南》中的相关规定以及设定相关规定的缘由进行梳理,给出了申请人在撰写专利申请时需要注意的有关事项,以及审查员在面对放弃式修改的答复意见时应该如何处理的建议。Undisclosed disclaimer is a special amendment method commonly found in the fi eld of chemistry.Guidelines for Patent Examination(2023)only gives an exemplary guideline by taking the amendment of a continuous numerical range as an example,which leads to some ambiguities in its judgment and specifi c operation in examination practice.Combining with the specifi c case,this article analyzes the relevant provisions in Guidelines for Patent Examination(2023)and the reasons for setting them on the basis of comparative analysis with similar provisions of other countries/regions,and sorts out how the examiner should deal with the undisclosed disclaimer and how the agent should draft the patent application.
