论专利侵权警告函的权利边界

摘　　要：专利作为知识产权的重要组成部分,我国法律对于专利权保护的制度不断完善。为了提高专利权人维护自身权益的效率,法律确立了专利侵权警告函,专利权人的权益受到侵害之后,可以通过向侵权人发布专利侵权警告函的方式,让侵权行为人停止侵权行为,保护专利权人的合法权益。但是,通过司法实践可以得知,由于法律对于专利侵权警告函的规定不完善,使得专利侵权警告函发布过程中,存在发布内容不真实,专利权人未尽到注意义务,以及专利侵权警告函发布的对象范围不确定等问题,导致专利侵权警告函发布中产生新的问题,专利权人作为侵权行为的受害人变成新的侵权行为人。通过分析专利侵权警告函适用过程中存在的问题,并针对这些问题提出相应的完善措施,明确专利侵权警告函的权利边界,合理规制专利侵权警告函的发布行为,充分发挥专利侵权警告函对当事人合法权益的保护。At present,the system of patent protection in China's laws has been continuously improved,and a warning letter of patent infringement has been established.After the rights and interests of the patentee are infringed,the infringer can be stopped by a warning letter of patent infringement.However,due to the imperfect provisions of the law on the warning letter of patent infringement,new problems may arise in the process of issuing the warning letter of patent infringement,and the patentee,as the victim of infringement,becomes a new infringer.This paper analyzes the problems existing in the application of the warning letter of patent infringement,and puts forward corresponding improvement measures to solve these problems,so as to clarify the right boundary of the warning letter of patent infringement,reasonably regulate the publishing behavior of the warning letter of patent infringement,and give full play to the protection of the legitimate rights and interests of the parties.
