摘　　要：全球数字贸易蓬勃发展的态势与传统国际贸易规制之间的矛盾日益突出。数字贸易发展态势体现为国际贸易中的交易主体、交易对象及交易方式的数字化,其背后的法理成因在于传统国际贸易规制的外部应对机制、内部层次结构、整体调整手段的迭代速度均滞后于数字贸易变革的速度。目前国际规制依托于双边和区域自由贸易协定等平台,从国际贸易规则数字化、国际规则内部结构多元化和规制手段科技化三个维度逐步演进。中国应在国际数字贸易规制塑造中有所作为,以服务国家利益为目标,以促进数字贸易自由化为发展方向。对此,中国应积极参与数字贸易新议题国际谈判,通过发展国际数字贸易来书写规则,并采用技术手段对贸易秩序进行规制。The contradiction between the booming development of global digital trade and the tradi-tional international trade regulation law is increasingly prominent.The development trend of digital trade is reflected in the digitalization of transaction subjects,transaction objects and transaction modes in inter-national trade.The legal reason behind it is that the external response mechanism,internal hierarchy structure and the iteration speed of overall adjustment means of traditional international trade regulations all lag behind the speed of digital trade reform.At present,international regulations rely on bilateral and regional free trade agreements proceed negotiation,and gradually evolve from three dimensions of interna-tional trade rules digitalization,internal structure diversification and regulatory means technicalization.Currently the international order of digital trade is in its infancy.China should make a difference in sha-ping the regulation of international digital trade,taking serving national interests as the goal and promo-ting digital trade liberalization as the development direction.In this regard,China should actively partici-pate in the international negotiations on the new issues of digital trade,write the rules by developing the international digital trade,and use technical means to regulate the trade order.
