涉外法治斗争的战略勇气与战术设计——以应对海外投资法律风险为视角

摘　　要：涉外法治斗争是维护国家主权、安全与发展利益的重要手段。应对海外投资法律风险,需要以法律为武器,敢于斗争,善于斗争,以法治斗争御风险、保安全,促合作、谋共赢。涉外法治斗争要有勇有谋,以充足的战略勇气敢于斗争,以科学的战术设计善于斗争。在海外投资实践中,我国的涉外法治斗争表现出敢于斗争的战略勇气不充足,善于斗争的战术设计不成熟,尚不能有效维护海外投资安全和利益。有勇有谋的涉外法治斗争需要从理论和实践两个维度探求智勇兼修的路径。需要正确认识斗争,丰富法治成果,提升法治能力,充实法治斗争的战略勇气;总结法治斗争的规律和方法,处理好斗争与合作、斗争与团结等多种复杂的事务关系,提升法治斗争的战术水平。Foreign-related legal struggles are an important means to safeguard national sovereignty,security,and development interests.To deal with the legal risks of overseas investment,we need to use the law as a weapon,dare to fight,and be good at fighting,using the rule of law to fight risks,ensure safety,promote cooperation and seek win-win results.The struggle for the rule of law involving foreign countries requires courage and strategy.To be brave enough to fight requires sufficient strategic courage,and to be good at fighting requires scientific tactical design.In the practice of overseas investment,China's foreign-related legal struggle shows that our strategic courage to fight is insufficient,and our tactical design of struggle is immature;it is still unable to effectively safeguard the security and interests of overseas investment.Courageous and strategic foreign-related legal struggles require exploring a path that combines wisdom and courage from both theoretical and practical dimensions.It is therefore necessary to correctly understand the struggle,enrich the achievements of the rule of law,improve the capacity of the rule of law,and enhance the strategic courage of the struggle for the rule of law.It is also necessary to summarize the principles and methods of the struggle for the foreign-related rule of law,effectively handle various complex affairs such as the relationships between struggle and cooperation,and between struggle and unity,and improve the tactical level of the struggle in this regard.
