论行政机制在污染环境犯罪治理中的应用

摘　　要：在多方参与的环境治理体系中,行政治理体系作用重大,不仅担当环境保护、环境监管、环境行政执法查处环境违法行为等诸多行政职能,还需要将环境监管执法中发现的涉嫌污染环境犯罪的案件移送处理。可以说,行政机制既是污染环境犯罪查处的前端机制,也是污染环境犯罪制裁的末端机制。在污染环境犯罪治理中,行政机制可以发挥启动刑事程序、协助司法机关查处犯罪案件、协助制裁污染环境犯罪的行为、协助完成污染环境犯罪判决的执行等不可或缺的重要作用。因此,应全面贯彻新发展理念引导机制完善工作,健全具有预防作用的行政监管执法机制,构建污染环境犯罪的案后行政追责机制,完善环境执法与刑事诉讼衔接的程序设计,构建行之有效的污染环境犯罪治理行政机制,实现生态环境行政执法能力现代化,遏制污染环境犯罪发生。In the multi-stakeholder environmental governance system,the administrative governance system plays a significant role.It not only carries out various administrative functions such as environmental protection,environmental regulation,and administrative law enforcement to investigate environmental violations but also needs to transfer cases involving suspected environmental crimes to relevant authorities.It can be said that the administrative mechanism is both the front-end mechanism for investigating pollution-related environmental crimes and the back-end mechanism for sanctioning them.In the governance of environmental crimes related to pollution,the administrative mechanism can play indispensable roles such as initiating criminal procedures,assisting judicial authorities in investigating criminal cases,facilitating the punishment of pollution-related environmental crimes,and assisting in the execution of judgments related to such crimes.Therefore,it is necessary to comprehensively implement the new development concept to guide the improvement of the mechanism,establish a preventive administrative supervision and law enforcement mechanism,create a post-case administrative accountability mechanism for pollution-related environmental crimes,enhance the procedural design for the connection between environmental law enforcement and criminal litigation,build effective administrative mechanisms for governing pollution-related environmental crimes,modernize the capacity of ecological environmental administrative law enforcement,and curb the occurrence of pollution-related environmental crimes.
