摘 要:现代意义上的罪数论,可追溯到普通法时代的刑法学,其发展变迁体现了对西方刑罚思想的继受。自日本最高裁判所时代以来,判例指引着罪数理论的发展,对牵连犯的限缩解释;连续犯删除后,接续犯概念对其功能的部分替代;想象竞合“单一行为”判断标准的确立以及根据实务要求提出的混合的包括一罪、连续的包括一罪等竞合形式,都无不打上了“实务主导”的烙印。而搭扣现象中罪刑不均衡现象的排除;共犯罪数的认定标准的厘清;竞合论明示机能下二重评价含义的匡正;罪数判断是否是不受事案影响的不变“法理”以及罪数论与诉讼法深刻关联的反思等问题,都是今后罪数论语境下的重要课题。In the modern sense,the theory of the number of crimes(derived from the Latin principle“Quot crimina,tot poena”)can be traced back to the criminal law studies of the common law era,and its development reflects the inheritance of Western penal thought.Since the era of the Japanese Supreme Court,precedents have guided the development of the theory of the number of crimes,with interpretations that limit the scope of joint offenders.After the removal of continuous offenses,the concept of successive offenses has partially replaced it.Establishing the judgment criterion of“single act”in the context of imaginary concurrence and proposing mixed forms,including one crime with a continuous crime,based on practical requirements,have all left their mark as being“practice-oriented”.Addressing the phenomenon of imbalance between crime and punishment in the context of aporia,clarifying the criteria for determining the number of co-offenders,correcting the dual evaluation meaning under the function competition theory,examining whether crime enumeration is an unchanging“legal principle”unaffected by specific cases,and reflecting on the profound connection between the theory of the number of crimes and procedural law are all important issues in the context of this theory in the future.
