摘　　要：清代末年,清政府颁布了一系列法律章程,使得中国现代司法体制开始建立,裁判过程随之发生变革,为民国时期司法制度的革新做了铺垫。当前由于各方面条件的限制,许多地方保留的民国司法档案还没有得到有效整理,因而对民国时期地方法院在新旧交替之下的司法裁判实践的研究,尚有许多空白之处。法源的继承和变迁是民国司法实践的重要方面,民国江苏地方法院的裁判文书对于民国时期习惯法在民事裁判中的运用有具体呈现,不仅直观反映出民国时期地方法院对中国传统习惯法利用的继承与赓续,同时也见证了新式法治理念下中国司法裁判制度的革新过程。The Qing government promulgated the Regulations for the Trial Operation of Trial Courts at All Levels,and China's modern judicial system began to be established,and the adjudication process was reformed accordingly.Due to the constraints of various conditions,the judicial archives of the Republic of China retained in many places have not been effectively organized,so there are still many research gaps in the practice of how local courts handled the relationship between the old and new systems during the Republic of China.The inheritance and change of legal sources is an important aspect of judicial practice in the Republic of China,and the judgment documents of the Jiangsu District Court of the Republic of China have a specific presentation of the application of the customs in civil adjudication during the Republic of China.It not only reflects the inheritance and reform of traditional customs during the Republic of China,but also intuitively reflects the continuation of traditional Chinese customs by the Jiangsu District Court of the Republic of China,as well as the innovation process under the new concept of rule of law.
