摘 要:行政法范畴是行政法中的基本问题,对该问题的再认识对于行政法体系的构建和行政法学理论的完善都具有重要意义。行政法范畴在目前我国的行政法实践和理论中呈现出构成上的多元性、分布上的不平衡性和关系上的重叠性等状况。行政法学理论中关于行政法范畴的认识存在由调整对象、由调控手段、由典则内容来确定行政法范畴等几类错误。然而,在行政法范畴确定的问题上,应当以全球一致性、历史延续性、目的物针对性和结构统一性作为理论基础。行政法范畴的再构设中应当包含作为行政法原则的范畴、作为行政法总则的范畴、作为部门管理法的范畴以及作为权利救济的范畴。The category of administrative law is the basic problem of administrative law,which has great impact on the construction of administrative law system and the perfection of administrative law theory.At present,the category of administrative law presents the diversity of composition,the imbalance of distribution and the overlap of relations in the practice and theory of administrative law in China.There are several kinds of mistakes in the understanding of the category of administrative law in the theory of administrative law,such as determining the category of administrative law by the object of adjustment,the means of regulation and control,and the content of codes.However,on the issue of determining the category of administrative law,it should be based on global consistency,historical continuity,object pertinence and structural unity.The reconstruction of the category of administrative law should include the category as the principle of administrative law,as the general principle of administrative law,as the category of department management law and as the category of right relief.
